User Policy
Please read the following carefully. If you have any questions,
please contact us at info@dedac.com. By signing up for service
with Dedac, you are agreeing to abide by our User Policy
below.
Role of Customer:
- It is your sole responsibility to determine if using
any access number provided by Dedac is a local call or
long distance call. We shall not, in any case, be responsible
for a customer’s local telephone charges or long distance
telephone charges.
- You assume total responsibility and liability for any
products or services acquired through the Internet, and you
agree that we are not liable for any product or
service acquired through the Internet that either directly
or indirectly causes you a loss.
- You have total responsibility for monitoring the content
of all information received through the Internet, and you
agree that we are not responsible or liable in any
way for material available through the Internet that some
may consider obscene or offensive.
- It is your responsibility to review or edit all material
downloaded from the Internet and that we are not liable
for any losses sustained due to problems with information
or programs received through the Internet.
- You agree that we are not liable for any losses sustained
by you either directly or indirectly due to loss of ability
of us to provide service due to any reason or negative
situation.
- You will not attempt to access computer systems or data
that you are not authorized to access.
- You will not engage in any activity that violates any
federal, state, or local law.
- You will not harass or otherwise disturb other Internet
users in any way, using our hardware, software, or network.
This includes unsolicited e-mails (“spam”) or broadcasts.
If you violate this policy, you will be assessed the following
fines and penalties, which you hereby agree to pay:
- First Offense: $100.00
- Second Offense: $500.00 and termination of your
account.
- You will be held liable for any costs incurred by us
as a result of your violation of any terms and conditions
in this agreement. This includes, but is not limited to,
attorneys’ fees and costs resulting from Postmaster responses
to complaints from and the cleanup of unsolicited commercial
mailings and/or unauthorized bulk mailings and/or news
server violations.
Role of Dedac:
- We will make all reasonable efforts to provide access
to the Internet for our customers.
- We do not warrant or guarantee any product or service
acquired either directly or indirectly through the Internet.
- We will not filter any information accessible through
the Internet.
- We will from time to time monitor activity to enable
us to continue to provide quality service.
- We will disclose any information necessary to satisfy
any law enforcement agency request.
- We will not intentionally disclose any personal information
unless required by law.
System Access:
- We provide a standard 56k dialup account for unlimited access per
month. Unlimited access is defined as having access to
our service 24/7. However, this is not an account for
a continuous 24 hours a day, 7 days a week connection.
- ISDN dialup access is limited to 200 hours per month.
- We reserve the right to logoff any user session after
approximately 10 minutes of inactivity or with approximately
5 hours of continual use.
- We prohibit the display of any material that violates
the law or is offensive or obscene in any website hosted
on equipment belonging to us.
- The equipment used by Dedac to provide services is designed
for speeds up to 56k flex connectivity. However, we cannot
guarantee a 56k connection if telephone company facilities
or your modem are unable to support this connection speed.
- With respect to dial-up accounts, Dedac’s usernames
are limited to one dial-in at a time. Multiple concurrent
dial-ins using the same username are not permitted.
- Upon request, we will provide disk space for a personal
shell account. This space is provided for personal use
only. Any website found that offers products or services
or appears to be a commercial site in any way will be
removed from the server at our discretion.
Payment for Service:
- If a credit card charge is declined or an e-check is
returned unpaid for any reason, service will be interrupted
immediately until the charge is accepted or the account
is paid current by some other method. We are under no
obligation to resubmit the credit card charge after receiving
notification of a declined charge.
- We will charge a $20 reactivation fee to any customer whose credit
card or echeck has been returned unpaid.
- Customers are responsible for their fees regardless
of their use of the system. Once you are 7 days into
the initial billing cycle, then you will be responsible
for the entire month.
- We may seek the service of various collection agencies
for excessively overdue accounts.
- We reserve the right to back bill any customer for services
used, but not billed.
Cancellation of Service:
- Customers may cancel their service by communicating
by email at billing@dedac.com,
or in writing to Dedac at our office at 6360 I-55 North,
Suite 310, Jackson, MS 39211, by fax at 601-956-5481.
We will terminate system access for you at the time you
request cancellation of service.
- If an internet access account is cancelled
within 7 days of the start of a service period, the Customer
will receive a full refund of fees paid with respect to
the period. If an account is cancelled after 7 days of
the start of a service period, no refund will be issued.
- We reserve the right at our sole discretion to terminate
any subscriber’s service.
Modification of User Policy:
- We reserve the right to modify our User Policy and you
agree to comply with the modified policy.
- You are responsible for checking the User Policy for
modifications.
